MADISON, Wis. (WTAQ) - A Waunakee man pleaded no contest Monday to causing the hit and run death of a Good Samaritan who was pushing a woman’s truck out of a snowbank in Madison.
Eugene Finley’s vehicle struck and killed 51-year-old David Wilhelm, and kept going. It happened 3 days before Christmas in 2008. Wilhelm suffered a brain injury, and he died almost a year later at a care facility in Sheboygan.
The 76-year-old Finley told Dane County Circuit Judge William Hanrahan he didn’t realize he struck Wilhelm as he kept driving. He said he only learned about it later. Finley struck a plea deal, and was supposed to be sentenced Monday. But the victim’s family asked for a pre-sentence investigation, so the judge delayed the sentencing until June 14th.
Attorneys on both sides agreed to seek 3 years of probation, including 150 days of home monitoring. Finley would lose his driver’s license for 5 years, and would have to abstain from drinking.
