WAUSAU, Wis. (WSAU) – A Marshfield man pled guilty Tuesday to negligent homicide charges in the death of a six-month-old Amish girl last summer.
Brian Witkus admitted that he rear-ended a horse-drawn buggy August 12th. The girl, Ada Mae Miller, and her mother Elizabeth were thrown from the buggy. Elizabeth, who was holding the infant, fell on top of her. Ada Miller later died at St. Joseph’s Hospital.
Witkus told police he had reached down to pick up a book from the floor of his van when the crash happened.
A judge dismissed a homicide by intoxicated use of a vehicle charge because prosecutors said they could not prove it beyond a reasonable doubt.
Both sides are free to argue what kind of sentence Witkus should get when he is sentenced July 13th. He faces up to 10 years in prison.
Witkus will remain free on bond until the sentencing.
