MADISON, WI (WTAQ) - The Wisconsin State Supreme Court will review the conviction of a Rhinelander man now serving 12 years in prison.
Matthew Lonkoski was convicted of leaving a morphine pill where his 10 month old daughter Peyton could reach it. The child swallowed the pill and died.
Lonkoski was convicted of child abuse and neglect for not seeking medical treatment for his daughter after he realized she had taken the powerful sedative.
Lonkoski is asking the state’s high court to throw out statements he made to police before his arrest as a violation of his Miranda rights.
The court will have to decide which of his comments were admissible.
