WAUSAU, Wis. (WSAU) - An man accused of murder might have key evidence thrown out.

19-year-old Zachary Froehlich is charged with several felonies including reckless homicide and robbery for the death of Kerby Kneiss in June of 2012. During a motions hearing Tuesday, Froehlich’s defense attorney Brian Bennett moved to eliminate Froehlich’s statements to Wausau Police investigators, claiming his client told them things after requesting an attorney and the statements should be inadmissible in court.

Judge Jill Falstad did not immediately rule on the motion, but if she agrees with the defense, it would disallow Froehlich’s statement admitting he swung the baseball bat that caused Kneiss’ death.

Judge Falstad may make her ruling on the motion December 5th. A jury trial is scheduled for Froehlich starting May 5th of next year.

Police say Froehlich and 21-year-old Warren Krohn robbed Kneiss before beating him to death.
