U.S. Supreme Court delays decision on Elmbrook graduation ceremony case

WASHINGTON D.C. (WTAQ) - The U.S. Supreme Court will wait for at least another week before deciding whether to take a case involving public high school graduations at Wisconsin’s Elmbrook Church.

The justices did not indicate Monday whether or not they’d take the case – but they placed it for consideration in a future weekly conference.

For almost two months, the Supreme Court has been debating whether to rule on the question of whether it was unconstitutional for two Brookfield high schools to hold their commencements at Elmbrook Church over the last decade.

The ceremonies were moved to a new school field house in 2010. For that reason, school officials had told a federal appeals court that the case is moot.

Still, the appellate court ruled last summer that the schools violated the separation of church and state by holding graduations where spectators could see a giant cross.

The school district appealed the ruling, saying the justices needed to answer the constitutional questions.
