MADISON, WI (WTAQ) - Kristen Smith told a federal court jury in Madison Wednesday that she did not kidnap her baby nephew -- and his father asked that she take him to her home near Denver.
The 31-year-old Smith faces up to life in prison on a federal kidnapping charge, for taking 5-day-old Kayden Powell from his mother near Beloit in February.
Smith testified that she took the youngster to Colorado because his parents would soon be moving there.
Kayden was found the next day in a tote outside an Iowa gas station in sub-zero temperatures, where he survived after being left for more than a day.
Smith said she dropped off the baby after a police officer called and wanted to pull her over, so her vehicle could be searched. She told the jury she was deprived of sleep at the time she was stopped along Interstate 80 in West Branch Iowa -- and she was not thinking straight.
Smith initially told police she didn't know where the baby was -- but she told the jury she made certain his electric blanket was plugged in when she abandoned him.
