WAUSAU, WI (WSAU) – A Wausau man who robbed a 15-year-old at gunpoint was sentenced to three years of probation. Devlin L. Benes, 19, will spend 6-months in jail if he violates the terms of probation.
Benes and another man drove a 15-year-old friend to Rib Mountain State Park in September, 2019. Benes pulled a gun, and took cash, an iPhone, a vape pen, and the victim’s sneakers. The two robbers also threatened a teenage girl in the car, telling her they would kill her family if she told police. She has since cooperated with prosecutors.
Benes was convicted in Marathon County Court of robbery with use of force, theft, and bail jumping.
He was also in court for two unrelated cases, and could be re-sentenced for those crimes if he violates the terms of his release. Benes was also ordered to pay restitution and to undergo counseling.
The second suspect, Davin G. Smith, 19, is scheduled for a plea hearing on December 17.
